Out of Work Rules

  1. The OVRCC maintains a non-discriminatory out-of-work list for use of members seeking employment.
  2. Any member seeking employment may register with his or her home office by personally signing the out-of-work list or by calling the office and requesting that his/her name be added to the list. The member shall indicate his/her name, local union, telephone numbers (up to two).
    1. A member shall have his/her name placed on the list by date.
    2. Retirees wishing employment shall sign the list and will be referred only if and after all full dues-paying members have been referred.
    3. A separate out-of-work list will be maintained in each office.
  3. Any member dispatched to a job or who is otherwise determined to be working will be removed from the out-of-work list.
  4. To maintain registration, members must contact the office every thirty (30) days. Any member who fails to do so, shall have his/her name removed from the out-of-work list.
  5. Upon receiving a request for employees, the Business Agent shall send those members qualified to perform the work, in the order of their registration on the out-of-work list. If a member cannot be contacted, then the next qualified person shall be contacted, and so on until the request has been filled.
  6. An employer may request a member by name, in which case, the member so requested will be referred provided he/she is currently on the out-of-work list.
  7. A member shall have his/her name removed from the out-of-work list for te following additional reasons:
    1. Referred to a job — except that any member who is rejected by the employer or fails to remain employed for more than five (5) working days, shall retain his/her position on the list.
    2. If a member is found working for a contractor and fails to notify the local.
    3. Any member refusing work three (3) times shall be removed from the list. (This does not apply to work that is outside the member’s registered work area.)
  8. Members are advised to register on the out-of-work list immediately upon layoff, termination, etc. At times, the unemployment office checks to see if a member has signed in.
  9. These procedures will remain in effect unless or until revised by the Executive Committee of the OVRCC.
